Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Olympian Hourglass LLC ("we," "us," or "our") governing your use of Tongues (the "App") and related services (together, the "Services").

Please read these Terms carefully. By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App. These Terms include important provisions that limit our liability and, in Section 15, require disputes to be resolved on an individual basis.

1. Eligibility

You must be at least [13] years old to use the App (or older where a higher minimum age applies under local law, such as 16 in parts of the European Economic Area). By using the App, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms. If you are a minor in your jurisdiction, you may use the App only with the involvement and consent of a parent or legal guardian.

2. Your Account

To use certain features, you must create an account. You agree to provide accurate information and to keep it current. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly at olympianhourglass@gmail.com if you believe your account has been compromised. We are not liable for losses arising from unauthorized use of your account.

3. License to Use the App

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the App for your own non-commercial language-learning purposes. We reserve all rights not expressly granted to you.

4. Subscriptions and Payments

The App may offer paid subscriptions and other purchases.

• Billing through app stores. Purchases are processed by the platform through which you downloaded the App (such as the Apple App Store or Google Play), not directly by us. Payment, billing, and refunds are subject to that platform's terms and your account settings with it.
• Auto-renewal. Subscriptions automatically renew for the same period and at the then-current price unless you cancel before the renewal date. Your account will be charged for renewal within the window specified by the app store (for example, within 24 hours before the end of the current period), unless auto-renewal is turned off beforehand.
• Managing and canceling. You can manage or cancel your subscription at any time through your app-store account settings. Cancellation takes effect at the end of the current billing period; you will continue to have access until then.
• Refunds. Except where required by law, payments are non-refundable, and refunds (if any) are handled by the relevant app store under its policies.
• Price changes. We may change subscription prices. Changes will not affect your current billing period and will apply only on renewal, with notice as required by law or the app store.
• Free trials. If we offer a free trial, unless you cancel before it ends, it will convert into a paid subscription and your account will be charged.

5. User Content and Sharing

The App allows you to create and store content such as study decks, and may allow you to share that content with, or use content shared by, other users ("User Content").

• You keep ownership. As between you and us, you retain ownership of the User Content you create.
• License you grant us. You grant Olympian Hourglass LLC a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify (for formatting and technical purposes), display, and distribute your User Content solely to operate and provide the Services — including, if you choose to share content, making it available to other users. This license ends when you delete your User Content or your account, except for content others have already saved or for copies retained as required by law or for backup.
• Your responsibility. You represent that you own or have the necessary rights to your User Content and that it does not violate these Terms or any law or third-party right (including intellectual-property and privacy rights). You are solely responsible for the content you create and share.
• Our discretion. We are not obligated to monitor User Content, but we may review, remove, or restrict any content that we believe violates these Terms or applicable law, at our discretion and without liability.

6. Acceptable Use

You agree not to:

• use the App for any unlawful purpose or in violation of these Terms;
• upload, share, or create content that is illegal, infringing, defamatory, hateful, harassing, sexually explicit, abusive, or otherwise objectionable;
• violate the intellectual-property, privacy, or other rights of others, including by submitting content you do not have the right to use;
• attempt to access, scrape, reverse-engineer, decompile, or interfere with the App, its servers, or its security;
• use the App to develop a competing product, or resell or commercially exploit the Services without our permission;
• upload viruses or malicious code, or otherwise disrupt the Services; or
• impersonate any person or misrepresent your affiliation.

We may suspend or terminate accounts that violate this Section.

7. AI-Generated Content; No Professional Reliance

The App uses artificial intelligence to provide translations, generate study materials, produce audio narration, and power other features. AI-generated output can be inaccurate, incomplete, or inappropriate for a given context, and may not reflect correct grammar, meaning, tone, or cultural usage.

You acknowledge that:

• the App is an educational tool and is not a substitute for a professional translator, interpreter, or language instructor;
• you should not rely on AI-generated translations or content for any high-stakes, legal, medical, financial, safety-critical, or official purpose; and
• you are responsible for independently verifying any output before relying on it.

We make no guarantee as to the accuracy, suitability, or completeness of any AI-generated content.

8. Our Intellectual Property

The App and the Services — including software, text, designs, graphics, logos, trademarks, and other materials we provide (excluding your User Content) — are owned by or licensed to Olympian Hourglass LLC and are protected by intellectual-property laws. You may not use our names, logos, or trademarks without our prior written permission. Except for the limited license in Section 3, nothing in these Terms transfers any of our intellectual-property rights to you.

9. Feedback

If you send us suggestions, ideas, or feedback about the App, you grant us the right to use them without restriction or obligation to you.

10. Third-Party Services

The App relies on and may link to third-party services (such as app stores, login providers, payment processors, and AI providers). Your use of those services is governed by their own terms and policies, and we are not responsible for them.

11. Termination

You may stop using the App and delete your account at any time. We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms or if we discontinue the Services. Upon termination, your license to use the App ends. Sections that by their nature should survive termination (including Sections 5, 7, 8, 12, 13, 14, and 15) will survive.

12. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT CONTENT (INCLUDING AI-GENERATED CONTENT) WILL BE ACCURATE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OLYMPIAN HOURGLASS LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) [USD $50 / $100]. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT FULLY APPLY TO YOU.

14. Indemnification

You agree to indemnify and hold harmless Olympian Hourglass LLC from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your User Content, your use of the Services, or your violation of these Terms or any law or third-party right.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of [STATE], without regard to its conflict-of-laws rules.

Please review this section carefully, as it affects your legal rights. Except where prohibited by law, any dispute arising out of or relating to these Terms or the Services will be resolved through binding individual arbitration administered by [ARBITRATION PROVIDER] in [LOCATION], rather than in court, and you and we waive the right to a jury trial and to participate in a class action. 16. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the App or by other reasonable means and update the "Last updated" date. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.

17. Apple App Store Additional Terms

If you download the App from the Apple App Store, the following applies: these Terms are between you and Olympian Hourglass LLC only, not Apple, and Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. Apple is not responsible for any product warranties or for addressing any claims relating to the App (including product-liability, legal-compliance, or intellectual-property claims). Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list.

18. Miscellaneous

These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Services. If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any right is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
